Under Fam. Code §3600, trial court did not err in granting W's request for s/s and atty's fees while prior appeal pending and her default had not been set aside.

Fees pendente lite may be awarded where it is probable W's prior divorce will be held void.

When marriage admitted and issue is validity of foreign divorce, court has broader discretion to order temporary support and fees.
