As Ps did not act w/in 30 days of remittitur, trial ct. did not err in granting Ds' motion to dismiss; no abuse of discretion in denying relief under discretionary and mandatory sections of CCP 473.

Demurrer improperly sustained where, while certificate of merit defective because not signed by P’s attorney, it was reasonably possible that she could cure defect by amending complaint.
