  • "According to proof" does not give defaulting D adequate notice of P’s demands; due process requires allegation of specific amount of damages in complaint, or, in PI case, service of statement of damages before entry of default.
  • Due process & Code Civ. Proc. §580 require Ds in muni. ct. action be given notice of precise amount of potential exposure if they fail to respond to complaint, even assuming they have constructive notice of jurisdictional limit.
